These Terms of Service ("Terms") govern your purchase, download, access, and use of all digital products sold on this website, including DAW Templates ("Templates") and PDF Guides ("Guides"), collectively referred to as "Digital Products." By completing a purchase or using any Digital Product in any way, you acknowledge that you have read, understood, and agreed to these Terms in full. If you do not agree, do not purchase, download, or use any Digital Products.

1. Digital Products – Final Sale / No Refunds

All products sold on this website are digital goods delivered electronically. Because digital products cannot be returned once accessed or downloaded, all sales are final.

No refunds, partial refunds, credits, or exchanges will be provided under any circumstances, including but not limited to:

• Accidental or mistaken purchases

• User dissatisfaction with content, workflow, or results

• Compatibility or system issues

• Failure to read the product description or requirements

• Changes in pricing, promotions, or availability

• Missing or expiring discounts, bundle deals, or limited-time offers

The only exception is a verified technical failure that prevents download or file access. If you experience a technical issue that prevents you from accessing your purchased file, contact us within 7 days of purchase for assistance or a replacement file.

Promotions are time-sensitive and non-retroactive. Purchases made outside a promotional period are not entitled to retroactive discounts or bundled offers.

2. License Grant & Permitted Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Digital Products as follows:

DAW Templates:

• Use for personal music production

• Use in commercial projects, including client work and released music

• Modify for your own workflow

PDF Guides:

• Read and reference for personal or professional development

• Apply the knowledge and techniques described within your own work

• Print a single copy for personal use

This license does not transfer ownership of any Digital Product. All rights not expressly granted are reserved by the creator.

3. Prohibited Use, Redistribution & Misrepresentation

You may not, under any circumstances:

• Resell, redistribute, share, gift, sublicense, or otherwise transfer any Digital Product

• Upload any Digital Product to any website, marketplace, forum, Discord server, cloud storage, or file-sharing platform

• Include any Digital Product in any product, service, or bundle offered for sale or free distribution

• Reproduce, copy, screenshot, or reformat the contents of any PDF Guide for distribution

• Claim authorship, ownership, or original creation of any Digital Product

• Remove or alter any copyright or ownership notices

Any unauthorized distribution or misrepresentation constitutes a material breach of these Terms and may result in immediate license termination and legal enforcement, including DMCA takedowns and civil claims.

4. No Software or Tools Included

DAW Templates are project files only and require third-party software to function. No DAW software is included with your purchase. You are solely responsible for obtaining, licensing, and maintaining a valid version of the required DAW and any third-party plugins.

PDF Guides require a PDF reader application to open. No software or tools are included with your purchase. BrandonMixing.com does not sell, license, or distribute any software.

All DAWs, plugins, software tools, trademarks, and brand names referenced remain the property of their respective owners.

5. Compatibility & User Responsibility

DAW Templates are provided based on the software versions available at the time of creation. Compatibility may vary due to DAW version updates, operating system changes, plugin availability, or hardware differences. No refunds will be issued due to incompatibility issues.

PDF Guides are delivered in standard PDF format. It is your responsibility to have a compatible PDF reader installed. No refunds will be issued due to inability to open a PDF file.

It is your responsibility to verify compatibility and system requirements prior to purchase.

6. No Guarantees or Performance Claims

Digital Products are tools and educational resources designed to improve workflow and knowledge. No guarantees are made regarding:

• Sound quality or creative output

• Commercial success or income results

• Time savings or productivity improvements

• Professional or financial outcomes

Any examples, demonstrations, or promotional claims are illustrative only and do not constitute a promise or warranty.

7. Limitation of Liability

To the fullest extent permitted by law, the creator shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use or inability to use any Digital Product, including but not limited to data loss, project corruption, software instability, lost income, or business interruption. Use of all Digital Products is entirely at your own risk.

8. Disclaimer of Warranties

All Digital Products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

9. Intellectual Property Rights

All Templates, Guides, designs, content, layouts, and associated materials are protected by copyright and intellectual property laws. Ownership remains with the creator at all times. Purchase does not transfer ownership — only a limited license under these Terms.

10. Termination

Any violation of these Terms may result in immediate termination of your license without notice. Upon termination, you must cease all use of the Digital Products and delete all copies in your possession.

11. Changes to These Terms

These Terms may be modified at any time. Continued use of the Digital Products after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
